The 32-year-old was pulled over at around 1.30pm on Monday while driving a BMW X5 on the Hume Highway at Braemar.

He will appear in Moss Vale Local Court on May 4.

Burgess retired after the 2019 season due to a chronic shoulder injury after scoring 44 tries in 182 games for Souths and winning a premiership in 2014.

It has been a tough period for Burgess since his retirement after he was charged and found guilty of intimidating his father in law Mitchell Hooke during a heated argument in the NSW Southern Highlands.

Burgess was found guilty of the charge after a heated clash near Bowral in the aftermath of his marriage break-up with wife Phoebe.

He was sentenced to a two-year community corrections order and given a two-year apprehended violence order.

Throughout the court proceedings, Phoebe and her father admitted to cooperating with the media and making allegations of explicit drug use and domestic violence.

Burgess spoke briefly outside of court after being found guilty of intimidating his father-in-law.

“(I’m) confused with the decision, we’ve appealed the decision,” Burgess said.

“I’m not going to say anything further. Thankyou.”

His lawyer Bryan Wench added: “He’s innocent, we will go all the way if necessary. He’s done nothing wrong.”

Burgess married Phoebe at her parents’ home in December 2015 and they have two children, four-year-old Poppy, and two-year-old Billy.

The couple separated in late 2018 before briefly reuniting in April 2019.

They split permanently on October 2 in 2019 and have since divorced.
